These Terms and Conditions (“Terms”) govern your access to and use of the 5alas platform (the “Platform”) operated by 5alas Charity Ltd (“5alas”, “we”, “us”, or “our”). By accessing, browsing, or registering on the Platform, you agree to comply with these Terms. Additional role-specific terms apply depending on whether you are a Donator, Supplier, Mosque, or Beneficiary.
1.1 In these Terms:
1.2 Headings are for convenience only and shall not affect interpretation.
2.1 Facilitator Role
(a) 5alas is a facilitator. We connect Donators, Suppliers, Mosques, and Beneficiaries.
(b) 5alas does not itself supply goods, deliver goods, or determine eligibility of Beneficiaries.
(c) Donations made via the Platform go directly towards the purchase of goods from Suppliers.
Where Donators choose to add an optional Support Contribution (currently 7.5%), this is a separate amount allocated to the Mosque once delivery and distribution are confirmed.
2.2 Eligibility
(a) You must be at least 18 years old to create an account.
(b) Organisations registering (e.g., Suppliers, Mosques) must be duly authorised and represented by individuals with legal capacity.
2.3 Account Security
(a) You are responsible for keeping your account credentials safe.
(b) You must notify 5alas immediately if you suspect unauthorised access to your account.
2.4 Acceptable Use
You must not:
(a) misuse the Platform, including attempting unauthorised access;
(b) provide false or misleading information;
(c) use the Platform for illegal, fraudulent, or abusive purposes.
2.5 Data Protection
Your personal data will be processed in accordance with our Privacy Policy, which forms part of these Terms.
2.6 Changes to Terms
We may update these Terms from time to time. We will notify you of material changes. Continued use of the Platform constitutes acceptance of updated Terms.
2.7 Liability
(a) To the maximum extent permitted by law, 5alas is not liable for any loss, damage, or claim arising from interactions between Donators, Suppliers, Mosques, or Beneficiaries.
(b) Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud.
2.8 Governing Law
These Terms, and any disputes arising under them, shall be governed by the laws of England and Wales. The courts of England shall have exclusive jurisdiction.
A1. Donations and Orders
(a) All donations and orders made through the Platform are final.
(b) Refunds will only be provided where required by law.
A2. Gift Aid
(a) If you wish to claim Gift Aid, you must provide a valid declaration and meet HMRC requirements.
(b) You are responsible for notifying us of any change in eligibility.
A3. Delivery and Distribution
(a) Donators acknowledge that goods are fulfilled by Suppliers and distributed by Mosques.
(b) 5alas does not guarantee the timing, quality, or specific allocation of goods.
A4. Fees and Payments
(a) Any additional fees (e.g., card processing charges) will be disclosed at checkout.
(b) Donators will receive confirmation of payment via the Platform.
A5. Optional Support Contribution
(a) At checkout, Donators may choose to add a voluntary Support Contribution (currently set at 7.5% of the order value).
(b) This contribution is not deducted from the Donator's main donation but added on top of it.
(c) The contribution is payable to the Mosque involved in the order, once delivery and distribution are confirmed.
(d) This contribution is optional and its percentage or structure may change in the future.
B1. Supply of Goods
(a) Suppliers must ensure goods are safe, lawful, and of satisfactory quality.
(b) Goods must match the description provided on the Platform.
B2. Delivery Obligations
(a) Suppliers must deliver goods to the designated Mosque within agreed timelines.
(b) Delivery must be confirmed on the Platform.
B3. Payments
(a) Suppliers will be paid the full order amount once delivery and receipt are confirmed.
(b) Payment delays may occur if confirmation is disputed.
B4. Compliance
(a) Suppliers must comply with all applicable UK consumer, health, and safety laws.
(b) Failure to meet service standards may result in suspension or termination.
C1. Receipt and Distribution
(a) Mosques must confirm receipt of goods via the Platform.
(b) Mosques must distribute goods only to registered Beneficiaries.
C2. Restrictions
(a) Goods must not be resold, exchanged, or distributed to non-eligible persons.
(b) Any misuse may result in termination of Platform access.
C3. Support Contribution
(a) Where a Donator opts to add an optional Support Contribution (currently 7.5%), Mosques will receive this amount once delivery and distribution of the goods have been confirmed on the Platform.
(b) This contribution is intended to support the Mosque's role in distribution and community services.
(c) The Support Contribution is separate from, and not deducted from, the value of donated goods.
C4. Accountability
Mosques must ensure volunteers act in compliance with 5alas policies and relevant charity regulations.
D1. Registration
(a) Beneficiaries must provide accurate information when registering.
(b) Proof of identity or 5alas reference numbers may be required to collect goods.
D2. Collection
(a) Goods may only be collected from the designated Mosque.
(b) Collection must be logged via the Platform.
D3. Restrictions
(a) Goods are for personal or household use only and must not be resold.
(b) Misuse may result in removal from the Platform.
4.1 Entire Agreement
These Terms, together with the relevant role-specific schedule, form the entire agreement between you and 5alas.
4.2 Severability
If any part of these Terms is invalid, the rest remains enforceable.
4.3 Assignment
You may not transfer your rights or obligations under these Terms without 5alas's consent.
4.4 Third-Party Rights
No person other than the parties to these Terms has rights under the Contracts (Rights of Third Parties) Act 1999.
